Entries received between Jan 1, 2007 and Dec 30, 2008 will be entered into a draw to be held on
January, 6 2009. All draws will be held at 1 p.m. at the Intrawest office located at 326-375 Water Street,
Vancouver, BC, V6B 5C6.
Two 7 Night Stay at Club Intrawest, in a studio at the Club Intrawest location of your choice,
excluding Kauai. The winner will also receive two set of airfare within continental North America and to Zihuatenjo,
Mexico (each individual round trip ticket value may not exceed $1000).
This offer is for a studio suite and black out periods will apply. All Holiday periods will be excluded.
Subject to availability. All taxes, fees and all other expenses and surcharges on prizes are the sole responsibility
of the prize winners. The prize must be redeemed before December 30, 2009.
Prize winners must be active Resort Pass Members and residents of Canada or the US.
Limit of one entry per person per e-mail address throughout the Sweepstakes Period.
Duplicate entries will not be valid. Entries become the property of Intrawest Resort Club Group (the “Sponsor”).
Employees of Intrawest Corporation, their affiliates and agents, participating partners,
contractors and immediate family members (defined as parents, children, siblings and spouse)
of each such employee, together with those with whom such employees are domiciled are not eligible.
The Sweepstakes is subject to all applicable federal, provincial, state, and local laws and regulations.
By participating, entrants agree to abide by and be bound by these Official
Sweepstakes Rules and to accept the decisions of the Sponsor as final.
All winners will be contacted by phone and/or by e-mail immediately after the draw.
In order to win a Prize, a Canadian resident prize claimant must correctly answer,
unaided, a time limited, arithmetical, skill-testing question to be administered by phone or email.
Potential winners of the Prize will be notified via email at the email address the winners provided
on the Sweepstakes entry form. The Grand Prize winner and his/her travel companions
(or their parent/legal guardian of a minor) are required to sign and return the Sponsor’s
Affidavit/Declaration of Eligibility and Compliance with the Official Rules and Release of Liability Form,
within 21 days from the time the prize notification is sent.
These documents will be delivered to the confirmed Grand Prize winner at the email
address provided on the Sweepstakes entry form. The prize will be forfeited if the prize notification is returned as non-deliverable,
if the skill-testing question is not correctly answered within the time period specified,
or if the Affidavit/Declaration and Release Form(s) is not returned within 21 days
from the time the prize notification package was sent.
Allow 2-3 weeks for delivery of all Secondary Prizes from date of prize acceptance.
Winners' names will be available at www.clubintrawest.com/resortpass.
Chances of winning are dependent on how many entries are received in each period.
Winners will be selected from all eligible entries by random selection.
Winners need not be present at time of selection.
In the event of a dispute regarding the identity of the person submitting an electronic entry,
the electronic entry will be deemed submitted by the person in whose name the email account is registered.
All drawings will be conducted by an independent judging organization whose decisions are final and binding on all matters relating to the Sweepstakes.
In no event will the Sponsor be obligated to award more than one Grand Prize.
All prizes will be awarded, provided they are properly claimed.
By participating, entrants agree to: (a) these Official Sweepstakes Rules and the decisions of the Sweepstakes Sponsor,
which shall be final in all respects; and (b) release, discharge, indemnify and hold harmless the Sweepstakes Sponsor,
each of its respective subsidiaries, affiliates, officers, directors, and employees,
including their promotional agencies, from any liability, claims, or damages, demands, actions,
or causes of action whatsoever which they, their heirs, successors, assigns, executors,
or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Sweepstakes and/or the acceptance or use,
misuse, or possession of any prize. By accepting a prize,
winners agree to the Sweepstakes Sponsor's and its designees' use of their names,
city, province, territory or state of residence and/or photograph for advertising and publicity purposes without compensation, except where prohibited.
The Sweepstakes Sponsor shall not be responsible for print or typographical errors in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, or illegible requests; or for prize claims that are posted late or incorrectly or are lost due to computer or electronic malfunction. The Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or technical failures compromise the integrity of the Sweepstakes as determined by the Sponsor in its sole discretion.
Any litigation respecting the conduct or organization of a public Sweepstakes may be submitted to the Régie des alcools des courses et des jeux for a ruling. All disputes regarding the awarding of a prize may be submitted to and settled by the Régie.
Participants agree that all disputes, claims and causes of action arising out of this promotion shall be resolved individually, without resort to any form of class action exclusively by arbitration in Vancouver, British Columbia and all claims shall be limited to actual out-of-pocket costs incurred, and in no event, attorney's fees. U.S. Participants hereby consent to the personal jurisdiction of the courts of Vancouver, British Columbia, and appoint any consul or vice-consul of the United States as their agent for the receipt of service of process.
Subject to other legal rights and remedies available to Participants under applicable provincial and/or state consumer protection laws, and subject to the Participants’ consent, the Participants agree that a simplified arbitration proceeding by a sole arbitrator shall be the initial recourse used to resolve any claim or dispute (whether originating in contract or tort, or pursuant to any applicable statutes, regulations or common law principles and whether past, present or future) that arises out of or is related to: (a) these Sweepstakes Rules; (b) any oral or written statements; or (c) any promotions or advertisements related to the Sweepstakes. Participants and Sponsor will make every reasonable effort to agree on the appointment of the arbitrator within fifteen (15) days of the commencement of the arbitration proceeding, failing which, the arbitrator will be appointed by the court in the province in which the Participants reside. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
